Fans purchase entries for the Raffle (“Raffle Entry”), each eligible participant (a “Participant”) represents that he/she meets all of the below-stated eligibility requirements and agrees to be bound by these Official Rules, all applicable laws, ordinances and regulations, and by the decisions of thesportsraffle.com, Kelly Sports Properties, LLC; a Division of Kelly Press Incorporated and your Charity, a 501(c)(3) charitable organization, or its authorized representative.

When you join a raffle you will be assigned 3 teams randomly selected from the MLB, NFL, NHL, NCAA Division 1 Football, NCAA Division 1 Men’s and Women’s Basketball, and NCAA Division 1 Softball Schedules, depending on the sport you chose to set up your raffle with. These 3 teams will remain your teams for the duration of the raffle time period predetermined by your raffle administrator (daily, weekly, monthly, 1st half of season, 2nd half of season, or full season).
Each week the total number of points/runs your 3 teams score will be ranked against the teams from all other entries. The Entry with the highest point/run/goal total wins 1st Place, the next highest will be awarded 2nd Place and so on. The number of winners will be predetermined by your raffle administrator. In the event of a tie, prize money will be evenly split.
RAFFLE ENTRY SALES PERIOD:
Raffle Entries will be sold online (as described below) throughout the period(s) predetermined by your raffle administrator for example: beginning at 12:00 a.m. EST on May 4, 20XX and concluding at 11:59 p.m EST on May 25, 20XX (the “Raffle Sales Period”).
RAFFLE PERIOD:
The duration of your raffle will be predetermined by your raffle administrator. When you sign up you will be assigned 3 teams randomly selected from the MLB, NFL, NHL, NCAA Division 1 Football, NCAA Division 1 Men’s and Women’s Basketball, and NCAA Division 1 Softball Schedules depending on what sport you chose to play your raffle with. These will remain your teams for the duration of the raffle.
Raffle Period options predetermined by your raffle administrator are defined as follows:
– Daily
– Weekly
– Monthly
– 1st Half of Season
– 2nd Half of Season
– Full Season
- For each $ donation, you will receive an entry in the Raffle. A Participant may enter at any time during the Raffle Period.
- Each Entry will qualify for the Current Raffle Period and all Subsequent Raffle Periods as predetermined by your raffle administrator.
- At no time will a Raffle Entry qualify for previously completed Raffle Periods
- A Participant may enter as often as they would like.
- Odds of winning are based on the total number of raffle tickets purchased during the raffle period.
- The total of number of Winners during each Raffle Period is predetermined by your raffle administrator.
- The total of number of Winners during all Raffle Periods are predetermined by your raffle administrator.

- If you enter during Raffle Sales Period on 4/1/20XX at 1:59 pm, entry will be active for each Raffle Period Week 1, 2 & 3.
- If you enter during Raffle Sales Period on 4/10/20XX at 11:59 am, entry will be active for each Raffle Period Week 1, 2 & 3.
- If you enter during Raffle Sales Period on 4/10/20XX at 12:01 pm, entry will be active for each Raffle Period Week 2 & 3.
- If you enter during Raffle Sales Period on 4/19/20XX at 5:07 pm, entry will be active for each Raffle Period Week 3.
ELIGIBILITY: The Raffle is open only to individuals who are of legal age (at least eighteen (18) years of age) at the time of purchase. Any employees, independent contractors or volunteers of thesportsraffle.com, Kelly Sports Properties, LLC; a Division of Kelly Press Incorporated who sell entries for a Raffle or participate in the administration of a Raffle are not eligible to enter or win the particular Raffle. The Raffle is subject to all applicable federal, state and local laws.
ENTRY: Participants may enter the Raffle by purchasing Raffle Entries online at www.thesportsraffle.com/XXXXX, or thesportsraffle app, while located in the Raffle Area (defined below) during the Raffle Period. Must be located within the State you wish to Register.

Online entry is void outside the Raffle Area and where prohibited by law, rule, or regulation. All Raffle Entry purchases must be made during the Raffle Period. Raffle Entries are not eligible to be entered into any past or future Raffle drawing. thesportsraffle.com and the other Released Parties (as defined below) are not liable for any lost, late, misdirected, incomplete, illegible, undelivered, or destroyed Raffle Entries regardless of cause or the person responsible, including, but not limited to, any problem or technical malfunction of any computer, online system or server or technical problem. No refunds will be made except as otherwise determined by thesportsraffle.com in its sole discretion.
RANDOMIZATION: Every transaction is electronically received and recorded into a secure database at thesportsraffle.com. The running total from Raffle Entry sales will be updated on thesportsraffle.com website and periodically posted on social media. A winning Raffle Entry will be determined at the conclusion of each Raffle Period from all eligible Raffle Entries purchased during the Raffle Period. The winners determined by thesportsraffle.com whose decision is final and binding.
PRIZE: Winners will receive a predetermined percentage of the total amount raised for the raffle. Prize amounts will be determined by the number of entries sold and the price per entry (determined by your raffle administrator).
Promptly following the raffle conclusion, the winning Raffle Entries will be posted on thesportsraffle.com social media and also online at thesportsraffle.com. The Participant that purchased the winning Raffle Entry with the corresponding winning Raffle Team Combinations (the “Prize Claimant”) will, subject to verification of eligibility and compliance with these Official Rules, receive a predetermined percentage of the net proceeds (total collected by thesportsraffle.com minus any related expenses from the Raffle Entry sales) for the Raffle Period or any other predetermined guaranteed, minimum payout announced by thesportsraffle.com for the particular Raffle (the “Prize”). All remaining net proceeds from the Raffle, a minimum of 50% of total proceeds (total collected by thesportsraffle.com for the Raffle Period), shall be retained by Charity found on the Team Registration Page.

CLAIMING THE PRIZE: Winners will receive a check for their winning amount after the raffle period has ended, or they can choose to have their winning amount credited to their “thesportsraffle.com account”. within thirty (30) days of the Prize Claimant confirming the winning Raffle Entry, executing an Affidavit of Eligibility & Liability/ Publicity (except where prohibited by law) Release, and completing all other required documents to thesportsraffle.com. For security and safety reasons, no cash payments will be made to the Prize winners. Unclaimed winnings will be retained by Charity found on the Team Registration Page. All Participants will receive an electronic confirmation code at the time of purchase, this electronic confirmation code is the only valid receipt for claiming the Prize for each winning Raffle Entry. To claim the Prize, the Prize Claimant must log on to their thesportsraffle.com account and confirm the winning Raffle Entry located on the Winners Confirmation page within thirty (30) days from the conclusion of the Raffle Period. Each Prize Claimant must provide thesportsraffle.com with all information required to claim the Prize (including any information necessary to determine eligibility requirements and tax identification information). The Prize Claimant will receive an Affidavit of Eligibility & Liability/Publicity (except where prohibited by law) Release (“Affidavit”) in the form approved by thesportsraffle.com which must be executed and returned to thesportsraffle.com prior to receipt of the Prize. In the event a Prize Claimant (a) does not notify thesportsraffle.com within thirty (30) days of the conclusion of the Raffle Period; (b) is ruled ineligible for any reason; (c) refuses the Prize; or (d) does not return an executed Affidavit of Eligibility & Liability/Publicity (except where prohibited by law) Release, the Prize will be forfeited and will be retained by thesportsraffle.com. thesportsraffle.com has no obligation to contact potential winners. WINNER NOTIFICATION: Winners will be notified via the email address they provided during registration.
ODDS: Odds of winning are based on the total number of raffle tickets purchased during the raffle period.
DIRECT FUNDING: To receive the funds you raise for your campaign, your organization will need to set up or link a Stripe payment account.
TAXES: Each Participant acknowledges that they have been informed that the IRS has taken the position that amounts paid for chances to participate in raffles, lotteries, or similar programs are not gifts and, therefore, the price of a Raffle Ticket does not qualify as a deductible charitable contribution. Each Prize winner is responsible for any and all federal, state and local taxes, fees and other government assessments on the awarded Prize. Furthermore, each Prize winner acknowledges that federal law requires that a tax withholding on certain prize values must be collected from winners upon award or distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time each Prize is claimed will be followed.
The IRS mandates that the value of a sweepstakes prize should be included in the winner’s gross income. If the value of the prize(s) is $600 or more, your organization will need to issue a Form 1099 to the winner. You can download a 1099 form here: Form 1099. The information provided on the 1099 Form should include the Charity’s Name, Address, Tax ID, the value of the prize, the winner’s name, address, and social security number. The amount of tax that the winner must pay on the prize is determined based on their income and their tax bracket.
TRANSFER OF RAFFLE TICKET: Raffle Tickets shall not be resold to any other party. Any Raffle Ticket which has been resold shall be void. All individuals who re-sell, purchase, or receive a Raffle Ticket in violation of these Official Rules shall be ineligible to participate in the Raffle or to win a Prize.
PARTICIPANT’S GRANT OF LICENSE: By participating in the Raffle or accepting a Prize, each Participant hereby irrevocably and perpetually grants to thesportsraffle.com, its designees, Kelly Sports Properties, LLC; a Division of Kelly Press Incorporated and the other ENTITIES, PROPERTIES or ENTERPRISES a worldwide license to use, publish, reproduce, create derivative works of, distribute and publicly display any images or likenesses taken or captured of such Participant in connection with any participation in the Raffle or receiving a Prize (collectively, the “Images”), in any form, media or content which now or hereafter exists, for advertising, promotional or any other commercial purposes as well as non-commercial purposes. Each Participant waives any compensation for any use of such Images. Each Participant hereby releases and waives any claims, demands, damages, losses, liabilities and causes of action arising from thesportsraffle.com’s, its designees’, Kelly Sports Properties, LLC; a Division of Kelly Press Incorporated and the other ENTITIES, PROPERTIES or ENTERPRISES uses of the Images, including, without limitation, any claims for defamation, libel, invasion of privacy, publicity, personality, or exploitation of the Participant’s name or likeness.
RELEASE OF LIABILITY AND INDEMNITY: By participating in the Raffle, the Participant on Participant’s behalf and on behalf of the Participant’s spouse, assigns, guardians, administrators, executors and legal representatives hereby releases, waives, discharges, covenants not to sue, and indemnifies thesportsraffle.com, Kelly Sports Properties, LLC; a Division of Kelly Press Incorporated and the other ENTITIES, PROPERTIES or ENTERPRISES, together with all of their past, present or future predecessors, successors, assigns, parent companies, subsidiaries, affiliates, related entities and persons, owners, shareholders, members, partners, trustees, elected officials, directors, principals, managers, employees, volunteers, agents, consultants, contractors, representatives, sponsors, and insurers (“Released Parties”) from any claim or loss arising out of or related to the Participant’s participation in the Raffle, acceptance of the Prize, or any exercise by thesportsraffle.com, its designees, Kelly Sports Properties, LLC; a Division of Kelly Press Incorporated and the other ENTITIES, PROPERTIES or ENTERPRISES of any of their rights set forth herein or the Official Rules of the Raffle, including, but not limited to, any claims related to (i) any injury to the Participant (including death) or the Participant’s property that occurs in connection with participation in the Raffle, receiving the Prize or any related activities, (ii) any failure to report and pay any income taxes arising from acceptance of the Prize, (iii) any lost or stolen Raffle Ticket, and (iii) the Participant’s acts or the acts of any other party with respect to the Participant’s receipt of the Prize, or participation in the Raffle, regardless of whether any such claims are caused in whole or in part by the negligence of any entity or person released here-under. Released Parties (a) make no warranty, guaranty or representation of any kind concerning any Prize, and (b) disclaim any implied warranty. The “MLB Entities”, “NFL Properties”, “NBA Properties”, “NHL Enterprises”, “NCAA Entity”, collectively ENTITIES, PROPERTIES or ENTERPRISES shall mean the Offices of the Commissioners of each individual ENTITY, PROPERTY or ENTERPRISE (“EPE”), its Bureaus, Committees, Subcommittees and Councils, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the EPE and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.
DISPUTES AND GOVERNING LAW: The Raffle shall be governed by the laws of the State of Missouri without giving effect to any choice of law or conflict of law rule of any jurisdiction. Any claims regarding the Raffle that are not released, must be brought in the State or Federal Courts in Boone County, Missouri, and Participant hereby consents to the personal jurisdiction of such courts for purposes of any such action. The Raffle is void where prohibited by law. Each Participant agrees that (1) any and all disputes, claims, and causes of action not waived arising out of or in connection with the Raffle, or any Prizes awarded, shall be resolved individually, without resorting to any form of class action; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Raffle, but in no event attorneys’ fees; and (3) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. DISQUALIFICATION; CHANGES: thesportsraffle.com reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the operation of the Raffle, re-sells a Raffle Ticket, violates the Official Rules, or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. thesportsraffle.com reserves the right to, at its sole discretion, cancel, suspend and/or modify the Raffle or these Official Rules or disqualify any individual or Raffle Ticket for purposes of protecting the integrity of the Raffle or addressing changes in business operations or other circumstances, to the extent allowed under applicable law. Raffles for charitable purposes may be allowed at the federal level for 501(c)(3) organizations (US) in many instances. These regulations make it very difficult to run an interstate raffle, and impossible to run one nationally. But for local fundraisers by 501(c)(3) organizations who qualify, raffles are a great way to raise money.
WHO IS ELIGIBLE TO RUN A RAFFLE?
The IRS considers raffles a form of gambling but does allow them to be run by qualified 501(c)3 nonprofit organizations. This means that all funds raised from a raffle must be sent directly to a 501(c)3 organization, and that organization must agree to take responsibility for the legal compliance of the raffle fundraiser. Please note: Online raffles are prohibited in Alabama, California, Hawaii, Kansas, Louisiana, Montana, New Jersey, Washington, and Utah. Sweepstakes are an alternative to a Raffle.
